With the rapid development of biotechnology, the physician is now more able to keep a patient's life going indefinitely on a life support system. The question of whether we should switch off the machine often arises when, according to the medical prognosis, there is no hope of recovery, or in a no-win situation where you are 'damned if you do and damned if you don't'. In a case which seems without hope, the dilemma of whether to prolong a life or (...) let it go disturbs many people, including health professionals as well as the family of the patient. In this painful situation, an ethics consultant who has received intensive training can help the concerned parties to arrive at what may be the best decision. How do Asians, especially those living in countries influenced by Confucian teachings, reach their answers? Three aspects are usually considered: (1) motivation and situation; (2) reasonableness and propriety; and (3) lawfulness and legality. More specifically, three questions are deliberated, as follows. (1) Where an action has already been taken, what motivated it and in what situation? Or, where a decision has still to be made, what should motivate it, and what are the relevant features of the situation? (2) Was the attempted resolution of the dilemma, or is its prospective resolution, reasonable and in accordance with traditional principles of ethical behaviour? (3) Was the action taken lawful, or would the intended action be lawful? This approach to finding an answer has been practised for centuries in Confucian society. But what is legal may not always be reasonable, what is reasonable may not always be compassionate, and what is compassionate may not always be either legal or reasonable. Principles to guide decision-making are therefore called for. Rejecting a morality based on religious sanctions and appeals to a spiritual order of being, David Hume advocated a wholehearted immersion in worldliness. Contemtus mundi is replaced with amor mundi, an orientation that Hume saw as fostering virtue and socially beneficial relationships.

Relevant to philosophy, law, management, and artificial intelligence, these papers explore the applicability of nonmonotonic or defeasible logic to normative reasoning. The resulting systems purport to solve well-known deontic paradoxes and to provide a better treatment than classical deontic logic does of prima facie obligation, conditional obligation, and priorities of normative principles.

The Cambridge Companion to Socrates is a collection of essays providing a comprehensive guide to Socrates, the most famous Greek philosopher. Because Socrates himself wrote nothing, our evidence comes from the writings of his friends (above all Plato), his enemies, and later writers. Socrates is thus a literary figure as well as a historical person. Both aspects of Socrates' legacy are covered in this volume. Socrates' character is full of paradox, and so are his philosophical views. These paradoxes have led (...) to deep differences in scholar's interpretation of Socrates and his thought. One final introductory thought. A great deal of the work that has been done from within the perspective of Whitehead's process metaphysics has been done with the very specific aim of showing how process thought is capable of grounding a modern reinterpretation of the notion of deity, a notion of deity that rests more easily amidst the concepts that engage the modern world than do the more traditional notions of deity. Some of the people I respect most highly in this (...) world are deeply involved in this theistic project, but that project is not, as is quite widely known, my project. I worry that the great attention paid to Whitehead's theistic readjustments has obscured Whitehead's rich availability when attention is turned toward more particularly philosophical issues. If the analyses and suggestions which follow prove to be plausible, perhaps they will encourage more research into ways that Whitehead's categories might be profitably directed upon issues and traditions out there in the wider philosophical world. But now I turn to reflections upon Whitehead, Sartre, and such notions as indeterminism and personhood. (shrink)

The contribution of food and diet to health is much disputed in the background culture in the US. Many commercial or ideological advocates make claims, sometimes with health as a primary goal, but often accompanied by commercial or ideological interests. These compete culturally with authoritative recommendations made by publicly funded groups. For public policy concerning diet and health to be legitimate, not only should it not be inconsistent with the scientific evidence, but also it should not be inconsistent with the (...) political environment. Healthy Eating Policy and Political Philosophy (HEPPP), by Barnhill and Bonotti (2022), addresses how policy in this complex area might be justified. In the present essay I highlight some important strengths of their work and also make some points about how it might be clarified or enlarged in scope. The great strength of HEPPP is that it emphasizes the role of a political philosophy in evaluating the legitimacy of public policy. They presume a well-off liberal democratic state, and specifically they draw on Rawls’ political liberalism, as developed in Political Liberalism (PL). One of several interlocking technical concepts developed in this book, public reason speaks to the boundaries of what should be acceptable in public deliberation about constitutional essentials and basic justice. HEPPP explores the application of an extension of public reason to the justification of policies related to “healthy eating.“ Public reason has two components, both of which pertain to a common understanding among citizens: (1) a common understanding of the principles and ideals that are the foundation of the political society, and (2) a common understanding of the standards that govern reason and evidence, including common sense. HEPPP argues that even though for diet and health the complexity of the scientific evidence goes far beyond anything like common sense for a typical citizen, the technical idea of “accessibility” of the scientific evidence justifies reliance on it within the concept of public reason. I question this accessibility argument about scientific evidence and public reason because the nature of the population-level epidemiological evidence about diet and health is that it often includes judgments that are based on arguable interpretations, framing incidence in terms of risk and prevention; thus the issue is more than one of potential accessibility of scientific evidence. Nevertheless, evaluation and consideration of the scientific evidence is of obvious practical importance in policy deliberation concerning policy related to what Rawls call “ordinary legislation.“ Even though public reason applied to healthy eating policy may not be as pertinent as it is for constitutional essentials and basic justice, and even though it is unlikely to result in a “correct outcome,“ invoking reasons based on political values and principles held in common has important value even in these deliberations about more ordinary questions. That value applies not to the specifics of the particular issue, but to the larger context for the particular policy being deliberated, as a potential contribution to an overlapping consensus that is stable for the right reasons. If this vision of political liberalism were achieved, then contentious debate about health eating policy and its scientific basis could occur within that context and be resolved within the basic political structure. Because public health and political liberalism have a common concern for a good at the population level, they have an underlying affinity. Healthy eating policies could be evaluated in two not-unrelated ways: based on their instrumental contribution to the good of the public body of citizens as population-level health, and according to their stabilizing contribution to an overlapping consensus among citizens. In this latter way a policy would contribute to a conditional integral common good a la Sulmasy, one that has the prospect of conditioning a political system, and by doing so create the conditions of the possibility of a constitutive integral common good that is constituted on the right reasons for allegiance to an overlapping consensus. To conclude with reference to HEPPP, public reason may play an important function with respect to the political common good, even as debates about the weight and meaning of scientific evidence from epidemiology play out in deliberation of ordinary legislation concerning healthy eating. Perhaps no one is more qualified to write about Japanese culture than Donald Keene, considered the leading interpreter of that nation's literature to the Western world. The author, editor, or translator of nearly three dozen books of criticism and works of literature, Keene now offers an enjoyable and beautifully written introduction to traditional Japanese culture for the general reader. The book acquaints the reader with Japanese aesthetics, poetry, fiction, and theater, and offers Keene's appreciations of these topics. Based on (...) lectures given at the New York Public Library, The Metropolitan Museum of Art, and the University of California, Los Angeles, the essays -though written by a renowned scholar- presuppose no knowledge of Japanese culture. Keene's deep learning, in fact, enables him to construct an overview as delightful to read as it is informative. His insights often illuminate aspects of traditional Japanese culture that endure today. One of these is the appreciation of "perishability." this appreciation os seen in countless little bits of Japanese life: in temples made of wood instead of durable materials; in the preference for objects -such as pottery- that are worn, broken, or used rather than new; and in the national love of the delicate cherry blossom, which normally falls after a brief three days of flowering. Keene quotes the fourteenth-century Buddhist monk Kenko, who wrote that "the most precious thing about life is its uncertainty." Throughout the volume, Keene demonstrates that the rich artistic and social traditions of Japan can indeed be understood by readers from our culture. Empirical research pertaining to cardiopulmonary resuscitation (CPR), clinician behaviors related to do-not-resuscitate (DNR) orders and substituted judgment suggests potential contributions to medical ethics. Research quantifying the likelihood of surviving CPR points to the need for further philosophical analysis of the limitations of the patient autonomy in decision making, the nature and definition of medical futility, and the relationship between futility and professional standards. Research on DNR orders has identified barriers to the goal of patient involvement in these life and death (...) discussions. The initial data on surrogate decision making also points to the need for a reexamination of the moral basis for substituted judgment, the moral authority of proxy decision making and the second-order status of the best interests standard. These examples of empirical research suggest that an interplay between empirical research, ethical analysis and policy development may represent a new form of interdisciplinary scholarship to improve clinical medicine. Christopher Boehm proposes that morality began when a society of hunter-gatherers punished a member for violating its rules. He claims social control of this kind is universal, and that apes have related tendencies. Emile Durkheim had a similar conception of social control in the simplest and earliest societies. But both are wrong: Hunter-gatherers rarely, if ever, handle conflict in a law-like and penal fashion, and the society as a whole rarely if ever is the agent of social control. Individuals typically (...) handle their own conflicts, and avoidance is more common than punishment. Pure sociology predicts and explains the handling of conflict with its location and direction in social space -- its social structure. The nature of morality depends, for example, on the social distance and degree of inequality between the parties, whether humans or nonhumans. Morality varies from case to case. It is relative rather than universal. Boehm therefore describes the origin of something that has never existed. All that is universal are the principles of structural relativity. (shrink)

In The Untamed God (2003), Jay Wesley Richards defends what he calls “theological essentialism,” which affirms God’s essential perfections but also recognizes contingent properties in God. This idea places Richards’s view in the vicinity of Charles Hartshorne’s dipolar theism. However, Richards argues that Hartshorne’s modal theory suffers from the defects that it abandons the principle ab esse ad posse, makes nonsense of our counter-factual discourse, and can only be expressed by C. I. Lewis’s S4, although for certain purposes Hartshorne needs (...) the stronger S5. Richards, however, fails to realize that Hartshorne’s theory involves two concepts of necessity—necessity as what is common to every possible world-state and necessity as it pertains to the unalterability of the past. While questions remain about Hartshorne’s theory, Richards’s arguments against it are unsuccessful. Most importantly, Richards uncritically accepts the concept of possible worlds as a basis for his critique, but Hartshorne’s arguments cast doubt on the coherence of this idea. Possible worlds provide anything but a firm foundation on which to make sense of either theological essentialism or Hartshorne’s panentheistic dipolar theism. (shrink)

This article examines two Buddhist explanations of how a conceptual cognition, whose object is a universal, can give rise to activity that leads to a particular. In both theories, that of Dharmottara and that of Ratnakīrti, this activity is due to a kind of error. A detailed investigation of how this error happens shows that there were big differences in the two underlying epistemological models.

Multiple pressures are today propelling the private sector towards corporate social responsibility (CSR) without detracting from the firm’s competitive advantage,profitability, and hence, its own sustainability. Achieving credible CSR is often a longterm process, taking years to fully develop, institute, and pay off financially, yet current research is limited by its ambiguity and methodological inconsistencies, and by the short time horizon of many studies. This paper responds to this gap by developing and testing a multifaceted, long-term model of firm sustainability practices. (...) The dataset we develop spans ten years, which to our knowledge is the first time such a cumulative long-term view has become possible in the study of CSR actions. Our findings reveal a number of significant relationships which together suggest the existence of a long-term “halo” effect in CSR-committed companies, whereby responsible behavior in the CSR arena is positively associated with other positive aspects of firm operations, including financial performance and a lack of evidence of “greenwashing.”.
